In many cases, German law protects tenants from arbitrary interference by the landlord. As long as they adhere to the tenancy agreement, there is usually no reason for trouble. But sometimes landlords do overstep their boundaries.

As long as tenants fulfil their obligations in the tenancy agreement and pay their rent on time, they hardly need to worry about termination. A special situation is required for this. This includes, for example, what is known as a notice of termination by the landlord. What is this all about and what do you need to bear in mind?

The new flat has been found, the boxes are packed, the deposit account has been cancelled - the move should go so smoothly. However, there are often one or two hurdles to overcome. It is particularly annoying when the old landlord makes life difficult and withholds the deposit. But are they even allowed to do this? And what do tenants have to bear in mind?

The statutory period of notice is stipulated in every tenancy agreement. This is usually three months, but a shorter period can also be agreed. Sometimes, however, it becomes necessary for the tenant or landlord to get out of the existing contract earlier. In such cases, a lease cancellation agreement can be negotiated. However, in order to avoid trouble later on, everything should be set out as precisely as possible.

Living space is in short supply in many German cities. Prospective tenants flock to viewings, bring application folders and in most cases have to continue their search. And even landlords sometimes find themselves in a situation where they need additional living space. In such cases, however, the tenant can only be given notice to quit if they give proper notice of their own requirements.
