Finally you have secured your new apartment, the boxes are packed, the deposit account is closed – the move should go smoothly like this. But often there are one or hurdles to overcome. It is particularly annoying when the old landlord makes life difficult and withholds the deposit. But is he allowed to do that? And what do tenants should know?

The statutory period of notice is stipulated in every rental agreement. It is usually three months, but a shorter period can also be agreed. Sometimes, however, it becomes necessary for the tenant or landlord to get out of the existing contract earlier. In such cases, a lease termination agreement can then be negotiated. In order to avoid later trouble, everything should be laid down as precisely as possible in it.

In many German cities, living space is in short supply. Prospective tenants come in droves to viewings, bring application portfolios with them, and yet in most cases have to continue their search. And even landlords sometimes find themselves in the situation of needing additional living space. In such cases, however, notice of termination to the tenant is only permissible if they properly register their own need.

Almost everyone who owns a pet or is considering getting one is familiar with the thought, “I’ll have to ask my landlord first if the pet can stay.” But is that even necessary? Is the landlord allowed to prohibit keeping the beloved pet in the apartment?
